Balkasa is an online real estate listing, advertising, and technology platform focused on property listings in the Balkans and nearby markets. Balkasa is not a real estate broker, real estate agent, property manager, escrow agent, title company, lender, lawyer, tax adviser, investment adviser, or payment intermediary unless expressly agreed in a separate written contract signed by Balkasa.

You may use the Services only if you can form a binding contract and are at least 18 years old or the age of legal majority in your country of residence, whichever is higher. Business users, agencies, developers, brokers, advertisers, and professional landlords represent that they are legally organized, licensed where required, and authorized to provide the information they submit.

You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for safeguarding login credentials and for all activity under your account. We may require identity, business, agency, ownership, authorization, licensing, or payment verification before allowing account access, listing publication, paid promotion, or continued use.

If you submit, import, upload, claim, edit, sponsor, or manage a property listing, you represent that you are authorized to publish it, that it is accurate and not misleading, that you have rights to submitted content, and that you will comply with real estate advertising, consumer protection, anti-discrimination, data protection, marketing, intellectual property, tax, and platform laws. You may not misrepresent price, size, location, ownership, availability, fees, legal status, permits, amenities, agency status, or transaction conditions.

Listings and communications are provided for informational and advertising purposes only. Users are responsible for their own diligence before buying, selling, renting, leasing, financing, visiting, reserving, or otherwise transacting with respect to any property, including verification of title, ownership, condition, location, permits, tax status, agency authority, legal compliance, zoning, encumbrances, fees, deposits, and transaction documents.

Balkasa may host, organize, rank, moderate, translate, format, promote, analyze, and display listings and user content. We may provide communication tools, but we are not a party to communications or transactions between users unless we enter into a separate signed agreement. We do not guarantee listing accuracy, user identity, legal compliance, transaction outcomes, continuous availability, leads, views, rankings, conversions, inquiries, or revenue.

Balkasa may offer paid subscriptions, listing packages, featured placements, advertising products, business tools, data products, promotional credits, lead products, or other paid services. Unless stated otherwise in writing, fees are charged in advance, non-refundable except where required by law, and subscriptions renew until cancelled. Taxes, VAT, duties, withholding, bank fees, currency conversion fees, chargeback fees, and similar amounts are your responsibility unless we are legally required to collect them.

Balkasa may rank, sort, recommend, promote, or display listings using automated and manual factors, including location, property type, price, availability, recency, listing quality, completeness, photos, filters, search terms, engagement, fraud signals, account status, advertiser budget, paid placement, subscription tier, commercial relationship with Balkasa, and other relevance or quality signals.

You retain ownership of User Content as between you and Balkasa. To the maximum extent permitted by law, you grant Balkasa a worldwide, non-exclusive, transferable, sublicensable, royalty-free, fully paid license to host, store, copy, reproduce, modify, adapt, translate, reformat, excerpt, index, cache, archive, create derivative works from, publish, display, perform, distribute, syndicate, promote, advertise, analyze, and otherwise use User Content in connection with operating, securing, improving, promoting, and developing the Services, listings, analytics, market insights, fraud prevention, quality scoring, and machine-learning systems.

If you provide suggestions, ideas, requests, improvements, bug reports, or other feedback, you grant Balkasa an unrestricted, perpetual, irrevocable, worldwide, royalty-free right to use that feedback without compensation or obligation to you.

Balkasa may collect, generate, and use service data, performance data, engagement data, clickstream data, search data, impression data, lead data, quality signals, fraud signals, and analytics data. To the extent such data is personal data, it is handled under the Privacy and Cookie Policy. De-identified, anonymized, aggregated, or statistical data may be used for any lawful business purpose.

You may not violate law or third-party rights; post fake, misleading, duplicate, bait, discriminatory, unlawful, or unauthorized listings; impersonate another person or business; scrape or misuse data except through authorized tools; upload malware; bypass controls; use the Services for spam, phishing, scams, money laundering, sanctions evasion, or unlawful payments; collect personal data without a lawful basis; post sensitive personal data without authorization; discriminate in housing activity; manipulate rankings or metrics; misuse Balkasa branding; or encourage others to violate these Terms.

We may review, refuse, remove, restrict, demote, label, edit, reformat, suspend, or terminate any account, listing, content, advertisement, product access, or paid service if we believe it may violate these Terms, law, third-party rights, platform integrity, user safety, payment requirements, verification requirements, or Balkasa's business interests. Where legally required, we will provide reasons, notice, complaint options, or other procedural rights.

If you believe content on Balkasa is illegal, infringes your rights, or violates these Terms, contact info@balkasa.com with a clear explanation, the exact URL or location of the content, your name and contact information, a statement that you believe the information is accurate and complete, and proof of ownership, authority, or rights where relevant. If your content or account is restricted and you believe we made a mistake, you may appeal by contacting info@balkasa.com.

Business users offering goods or services to consumers are responsible for providing accurate trader identity, contact, license, registration, tax, and legally required consumer information. Balkasa may provide listing metrics, invoices, subscription data, account data, and leads through dashboards, exports, APIs, or support channels as available, and may change, limit, or discontinue data access where necessary for privacy, security, product, legal, or business reasons.

The Services, software, design, layout, databases, data compilations, trademarks, logos, trade names, rankings, algorithms, analytics, and other Balkasa materials are owned by Balkasa or its licensors and are protected by intellectual property and other laws. Except for rights expressly granted in these Terms, no rights are transferred to you.

The Services may integrate or link to third-party services such as payment processors, map providers, analytics providers, hosting providers, communication tools, identity verification vendors, advertising partners, social networks, and external websites. Balkasa is not responsible for third-party services, terms, policies, content, or conduct.

Our collection and use of personal data is described in the Privacy and Cookie Policy. By using the Services, you acknowledge that we process personal data as described there.

To the maximum extent permitted by law, the Services are provided "as is" and "as available." Balkasa disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and quiet enjoyment. We do not guarantee listings, users, agencies, developers, owners, properties, prices, transactions, documents, communications, or outcomes.

To the maximum extent permitted by law, Balkasa and its owners, managers, officers, employees, contractors, affiliates, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, loss-of-data, goodwill, business, revenue, savings, property opportunity, or transaction opportunity damages. To the maximum extent permitted by law, total liability will not exceed the greater of the amount paid to Balkasa for the relevant service during the three months before the event giving rise to liability or USD 100.

You agree to defend, indemnify, and hold harmless Balkasa and its owners, managers, officers, employees, contractors, affiliates, suppliers, and licensors from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Services, User Content, listings, transactions, communications, violation of these Terms or law, violation of third-party rights, taxes, licenses, permits, authorizations, disclosures, fraud, negligence, willful misconduct, or misrepresentation.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except that mandatory consumer protection, data protection, or platform laws of your country may apply where they cannot lawfully be waived. Unless prohibited by applicable law, disputes must be resolved individually and not as a class, consolidated, collective, or representative action. The parties will first attempt informal resolution by written notice to info@balkasa.com.

You may not use the Services if you are located in, organized under the laws of, ordinarily resident in, or acting on behalf of any country, territory, person, or entity subject to applicable sanctions or trade restrictions that prohibit the Services. You may not use the Services for prohibited exports, re-exports, or transactions.

We may change the Services or these Terms from time to time. If changes are material and legally require notice, we will provide notice by email, dashboard notice, website notice, app notice, or another reasonable method. Continued use after the effective date means you accept the updated Terms.

These Terms, together with applicable order forms, product terms, and policies, are the entire agreement between you and Balkasa regarding the Services. If any provision is unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent. Balkasa may assign them in connection with a merger, acquisition, restructuring, sale of assets, financing, or by operation of law.
